Agreement to Terms
By using Easel, you agree to these Terms of Service and our Privacy Policy and Acceptable Use Policy. If you don't agree, please don't use our service.
Service Description
Easel is an ecommerce platform that allows you to create and manage online stores. We provide:
- Store creation and management tools
- Product catalog and inventory management
- Order processing and customer management
- Payment processing integration via Stripe
- Technical support and maintenance
Account Registration
To use Easel, you must:
- Be at least 18 years old or have parental consent
- Provide accurate registration information
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
- Use the service for lawful business purposes only
Subscription and Billing
Pricing
Current pricing is $199/month with a 30-day free trial. Prices may change with 30 days notice to existing customers.
Payment
- Subscriptions are billed monthly in advance
- Payment is due immediately upon subscription
- We accept major credit cards via Stripe
- Failed payments may result in service suspension
Refunds
30-day money-back guarantee from initial payment. No refunds for partial months after the first 30 days.
Free Trial
30-day free trial includes full platform access with trial watermarks. No credit card required. Trial extensions may be available upon request.
Data Ownership and Retention
You retain complete ownership of your data:
- All store content, products, and customer data belongs to you
- You can export all data at any time from your dashboard
- Data export remains available even if payments are overdue
Data Deletion
- Trial accounts: Data deleted 90 days after trial ends if no paid subscription starts
- Canceled accounts: Data deleted 90 days after subscription ends
- Terminated accounts: Data deleted immediately upon termination for policy violations
Data export is your responsibility - we don't provide backups after deletion.
Service Availability
We strive for high availability but don't guarantee 100% uptime. We may:
- Perform scheduled maintenance with advance notice
- Experience unplanned outages beyond our control
- Temporarily suspend service for security or legal reasons
Service level agreements are not provided given our pricing model.
User Responsibilities
You are responsible for:
- Complying with all applicable laws and regulations
- Following our Acceptable Use Policy
- Maintaining accurate product information and pricing
- Handling customer service for your store
- Managing tax obligations for your sales
- Keeping your contact information current
Prohibited Activities
You may not:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Attempt to hack, disrupt, or abuse our systems
- Use our service to sell prohibited items (see Acceptable Use Policy)
- Spam, phish, or engage in fraudulent activities
- Resell or redistribute our service without permission
Termination
By You
You may cancel your subscription at any time. Service continues until the end of your current billing period.
By Us
We may terminate your account immediately for:
- Violation of these Terms or our policies
- Non-payment after reasonable notice
- Illegal activities or abuse of our systems
- Behavior that harms other users or our reputation
Intellectual Property
You retain ownership of content you create. Easel retains ownership of:
- The Easel platform, software, and technology
- Our trademarks, logos, and brand materials
- Documentation, guides, and support materials
Our source code is available under the AGPLv3 license at git.sr.ht/~egtann/easel.
Third-Party Services
Easel integrates with third-party services:
- Stripe: Payment processing (subject to Stripe's terms)
- Email providers: Transactional email delivery
These services have their own terms and privacy policies.
Disclaimers
Easel is provided "as is" without warranties:
- We don't guarantee the service will meet all your needs
- We can't control third-party integrations or their availability
- Internet connectivity and device compatibility may vary
- You use the service at your own risk
Limitation of Liability
Our liability is limited to the amount you paid in the 12 months before any claim. We're not liable for:
- Lost profits, revenue, or business opportunities
- Data loss (though we provide export tools)
- Third-party service failures or integration issues
- Indirect, consequential, or punitive damages
Governing Law
These Terms are governed by California law. Disputes will be resolved in California courts or through binding arbitration.
Changes to Terms
We may update these Terms with 30 days notice via email or your account dashboard. Major changes affecting pricing or core functionality will receive additional notice. Continued use constitutes acceptance of updated terms.
